Plain-English Summary
The BowerNest pilot program is free for all participants during the pilot period. You will be using a pre-release version of the platform, which means some features may not work perfectly. Your feedback will help us improve the platform. We will give you at least 30 days notice before the pilot ends, and you will have the opportunity to transition to the full platform or export your data.
1. Purpose
These Pilot Program Terms and Conditions ("Pilot Terms") govern participation in the BowerNest Pilot Program ("Pilot"). The Pilot is designed to test and validate the BowerNest platform with a limited group of users before broader release. These Pilot Terms supplement the general Terms of Use and, in the event of any conflict, these Pilot Terms will prevail for matters relating to the Pilot.
2. Eligibility
The Pilot is open to:
- trade apprentices currently enrolled or seeking enrolment in an apprenticeship in New South Wales;
- employers in the construction and trades sector in New South Wales;
- registered training organisations (RTOs) and TAFEs in New South Wales;
- parents and guardians of apprentices; and
- other stakeholders invited by BowerNest to participate.
BowerNest reserves the right to accept or decline any application to participate in the Pilot at its discretion.
3. Cost
Participation in the Pilot is free for all participants during the pilot period. There is no cost and no obligation to continue using the platform after the Pilot concludes. BowerNest will not charge any fees for access to the platform during the Pilot period.
4. Pre-Release Acknowledgement
By participating in the Pilot, you acknowledge and agree that:
- the platform is a pre-release version and may contain bugs, errors, or incomplete features;
- the platform may not perform as expected in all circumstances;
- BowerNest may modify, update, or remove features during the Pilot without prior notice;
- data collected during the Pilot may be used to improve the platform (in accordance with our Privacy Policy); and
- the availability of the platform during the Pilot is not guaranteed.
5. Feedback
Pilot participants are encouraged to provide feedback on their experience with the platform. By providing feedback, you grant BowerNest a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, and incorporate your feedback into the platform and related products and services. BowerNest is not obligated to implement any feedback or to compensate you for feedback provided.
6. Data During the Pilot
Personal information collected during the Pilot will be handled in accordance with our Privacy Policy. At the conclusion of the Pilot:
- participants will have the option to transition their account and data to the full platform (if available); or
- participants may request deletion of their data in accordance with our Data Retention Policy.
7. Duration and Termination
The Pilot will run for a defined period, the dates of which will be communicated to participants. BowerNest reserves the right to extend, modify, or terminate the Pilot at any time. BowerNest will provide at least 30 days written notice before terminating the Pilot, except in circumstances where immediate termination is necessary for security, legal, or operational reasons.
8. Transition
At the conclusion of the Pilot, BowerNest will provide participants with information about the transition to the full platform, including any changes to terms, features, or pricing. Participants will have the opportunity to review and accept the updated terms before continuing to use the platform.
9. Limitation of Liability
To the maximum extent permitted by law, BowerNest's liability in connection with the Pilot is limited to re-supplying the services or paying the cost of having the services re-supplied. BowerNest does not exclude or limit any rights you may have under the Australian Consumer Law that cannot be excluded or limited by law.
